BRIBERY ACT: Guidance Update

Following a recent announcement on the expected changes to Serious Fraud Office (SFO) guidance for the 2010 Bribery Act, businesses have not had to wait long for further updates. 

On 09 October 2012, the new guidance was made available. In general, the updated advice indicates a stricter stance on tackling bribery, particularly with regard to self-reporting. The SFO will no longer guarantee that a criminal prosecution will not follow any corporate admittance of bribery if there is a “reasonable prospect of conviction” and it is “in the public interest.” Further changes were made to advice on facilitation payments (an uncontroversial emphasis that these are illegal) and corporate hospitality (a clear reiteration of previous statements).
